Workers' Compensation

Most people who are injured at work assume that their employer will take care of them - and that the insurance company handling their claim will pay them all the benefits they are entitled to receive under Kentucky law. Unfortunately, it doesn’t always work out that way.

Big insurance companies are not in business to pay claims. They are in business to collect premiums., That means they have an incentive to pay you the smallest benefit they can for your workplace injury. Unless you have an experienced workers’ compensation lawyer handling your injury case, you will have very little leverage in your negotiations. Many times, the insurance company will claim that a claimed work injury is a pre-existing injury, or that it happened someplace other than the workplace. As a result, many disabled workers find themselves with mounting medical bills and no income. A few even find themselves out of work after their employer finds an excuse to fire them.

The workers compensation lawyers at Sampson & Slechter, PLLC are dedicated to protecting your rights under Kentucky law. Your employer cannot fire you or otherwise retaliate against you for filing a workers’ compensation claim. If your employer does fire you, we will help you file a lawsuit against your employer for damages.

Our lawyers will make sure that you receive all of the workers’ compensation benefits you are entitled to receive under Kentucky law, including:

  1. Medical Care for your injury;
  2. Temporary Total Disability (TTD) benefits to replace lost wages;
  3. Permanent disability benefits (if you are totally or partially disabled from your workplace accident); and
  4. Vocational retraining if you lack the capacity to perform your old job.

Our firm has helped thousands of injured workers across Kentucky, including construction workers, coal miners, office workers and assembly line employees. We have helped people with all types of injuries, including back injuries, neck injuries, shoulder injuries, arm injuries, amputations, burns and carpal tunnel syndrome. If you are totally disabled and unable to return to work, we will also help you apply for disability benefits from Social Security.

Our services will cost you nothing up front. We advance the costs of investigating your case. If we don’t win or settle your case, you owe us nothing. If we are successful, Kentucky state law limits attorney fees in workers’ compensation cases to 20 percent of the first $25,000 in benefits, 15 percent of the next $10,000, and 5 percent of the remainder. Attorneys’ fees in workers’ compensation cases are capped at $12,000, regardless of how much we recover on your case.

Of course, there’s no way to guarantee the outcome of any case. Whether you hire our law firm or not, however, we recommend that you hire a workers’ compensation lawyer if you have been hurt in a workplace accident.
